Public offer contract
about making a charitable donation

This Public Offer to provide a charitable donation (hereinafter referred to as the Offer) is directed to an unspecified group of individuals (hereinafter referred to as the Benefactor) and is a public offer of the Charity Organization "Ukraine Lives 2022", represented by the Director Pahol Borys Yevhenovich, which operates on the basis of the Charter (hereinafter_cc781905- 5cde-3194-bb3b-136bad5cf58d_ — Foundation), conclude an agreement on the provision of a charitable donation, under the conditions specified below.
 

Terms used in this Agreement:

  • Public offer - a valid offer of the Organization posted on the website: https://www.ua2022.org/, on the provision of a charitable donation aimed at an undefined circle of individuals.

  • Acceptance - full and unconditional acceptance of the Offer by taking actions aimed at making a money transfer using payment forms and means, both posted on the website, and by transferring funds to the Fund's current account through bank institutions. The offer is considered accepted from the date of crediting the funds to the current account of the Organization.

  • Charitable donation is a free transfer of funds by the Benefactor to the property of the Foundation for the achievement of certain goals provided for by the Foundation's Charter or programs, in accordance with the Foundation's Charter and this Agreement.

  • A benefactor is an able-bodied natural person who voluntarily carries out one or more types of charitable activities. For the purposes of this Agreement, the Benefactor is an individual who accepted the Offer.
     

2. SUBJECT OF THE AGREEMENT

2.1. The subject of this Agreement is the free and voluntary transfer of funds by the Benefactor into the ownership of the Fund by making a charitable donation to ensure the statutory activities of the Fund. The benefactor independently determines the amount and directions of use of the charitable donation.

2.2. The execution of this Agreement by the parties is not aimed at obtaining profit or any benefits for any of the parties.

2.3. The Parties confirm that the subject of this Agreement is not direct or indirect profit-making by any of the Parties.
 

3. ACCEPTANCE

3. 1. By accepting the Offer, the Benefactor indicates that he agrees with all the terms of the Offer, is fully aware of and agrees with the subject of the Agreement, the purpose of public fundraising, and also confirms the Foundation's right to use the Charitable Donation for the Foundation's administrative expenses.


4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. The Benefactor has the right to make a Charitable Donation to the Foundation throughout the term of this Agreement, without limitations in terms of size and number of times.

4.2. The parties have the right to use and distribute information about the Donation by the Benefactor and about his participation in assisting the Foundation in the realization of the goals defined by the Charter.

4.3. The Foundation undertakes to own, use and dispose of the Charitable Donation for the realization of the goals defined by the Charter.

4.4. The Foundation undertakes to provide, at the benefactor's request, a report on the direction and purposes of using the Charitable Donation.
 

5. TERM OF COLLECTION OF FUNDS

5.1. Public collection of funds continues until the termination of the Fund's activities (including through liquidation), unless another period is determined by the Fund's decision, about which the Benefactor will be notified by placing relevant information on the website: https://www.ua2022.org/

5.2. The benefactor consents to the fact that in case of non-implementation of projects or the presence of balances, such amounts of donations are not subject to return and will be used for the statutory activities of the Foundation.


6. LIABILITY OF THE FUND

6.1. The Foundation is responsible for the violation of the terms of this Agreement and the use of Charitable Donations contrary to the procedure provided for by the Foundation's statutory activities and the legislation of Ukraine.


7. OTHER TERMS

7.1. Expenses related to the transfer of Charitable donations (commissions for transfer of funds, taxes, fees, etc.) are borne by the Benefactor.

7.2. By accepting the Offer, the Benefactor confirms that he is fully and completely acquainted with and agrees with its terms, and also gives permission for the processing of his personal data in order to be able to fulfill the terms of the Offer. The permission to process personal data is valid for the entire period of validity of the Offer. In addition, by concluding the Offer, the Benefactor confirms that he has been notified (without additional notification) of the rights established by the Law of Ukraine "On the Protection of Personal Data". The Benefactor's rights as a subject of personal data in accordance with the Law of Ukraine "On the Protection of Personal Data" are known and understood by him.

7.3. The benefactor consents to the fact that after entering information about himself on the Foundation's website, his contact information may be used by the Foundation to send letters and messages, including in electronic form. At the same time, the Foundation undertakes not to provide information about the Benefactor's contact details to third parties, except in cases provided for by the legislation of Ukraine. In addition, the Benefactor gives his consent that information about him (in particular, surname, first name, patronymic) may be used by the Foundation in mass media or on the Organization's website: https://www.ua2022.org/
